Special rules apply when compensation is awarded to a child. One key feature is that a Court must approve the compensation award on behalf of the child, even if it is agreed between the parties. A judge has responsibility to consider the terms of settlement to ensure they are reasonable and proper for the child.

The Court must also decide how the child’s compensation fund should be investigated. This can be complex in higher value claims and our solicitors have specific expertise in handling these types of cases.

Legally, once a child has turned 18 they have 3 years to pursue a claim compensation if it wasn’t done for them whilst they were a minor. A parent of guardian making a claim for compensation on behalf of an injured minor is referred to as a ‘litigation friend’. The litigation friend must be independent, therefore if a parent was to blame for the accident (perhaps they were driving, and their child was a passenger in the car), they cannot act as their litigation friend.

Accidents abroad

If you have been involved in an accident abroad and it was caused by someone else’s negligence, you are entitled to claim compensation in the same way that you can in the UK. There are however differences in how you approach making a claim that requires the assistance of expert solicitors who understand the process.

If you were working abroad at the time of the accident, you may be entitled to make a claim against your employer if they are based in the UK or have a registered office in the UK.

If you were on holiday at the time of the accident, and you booked your holiday through a UK travel agent, there are many circumstances in which you can make a claim against your tour operator.
