The rules give clear guidance on the professional standards expected of solicitors when carrying out their duty of care to clients and encourages exemplary service. The latest addition of the Code of Conduct can be viewed on the SRA website here, and will provide useful guidance on whether you may or may not have a case for professional negligence.
Many complaints about a solicitor, such as delays in returning calls or providing updates can be dealt with in-house as all law firms must have a complaints policy.
However, if a solicitor makes a serious mistake which results in the client losing out in some way then a client may have a professional negligence claim.
Examples of professional negligence include:
If you believe that your solicitor has been negligent, and you have suffered financial loss as a result, you may be entitled to compensation.
You must be able to show that they breached their professional duty of care and that their conduct fell below the standard of a competent solicitor in the same area of expertise. You must also be able to prove that the negligence actually caused you to suffer a loss.
