When clients turn to us for help when things have gone wrong in the dentist’s chair, invariably they are distressed and often experiencing considerable pain and discomfort. Not only do we help clients in a legal sense, we also support them in seeking restorative dental treatment.
Dental negligence can cover a wide variety of claims from (and yes it does happen) extraction of the wrong tooth, or in the most extreme circumstances, wholesale failure to adequately care for someone’s teeth over a number of years.
Is it any wonder some people have a phobia of dentists?!
One of the worst dentist cases I’ve worked on involved wholesale failures of treatment involving 15 teeth. Over a period of 10 years, my client was treated by his local Norwich dentist who unnecessarily removed and crowned half of his teeth rather than properly treating them. Not only could many of his original teeth have been saved, the ones that were removed, weren’t properly extracted with teeth roots left within the mouth.
The treatment the Claimant required in order to sort his teeth out meant that all those remaining in both the upper and lower jaws, required removal followed by implants and an implanted retained over denture. The costs were extremely high and he needed extensive, lengthy treatment.
Fortunately, dentists who are this bad at treating patients are few and far between. In this case the defence organisation on behalf of the dentist admitted responsibility early in the case which meant that it became our job to argue about was the value of the claim. It ultimately settled at a figure that our client was more than happy with. We even managed to make him smile again!
