The claimant was a passenger in a vehicle involved in a hit and run accident.
The claimant suffered a fracture of the sacrum at S3 and S4 level in the lower back. She also suffered whiplash injuries to her neck and a nasty seat belt abrasion across her right chest including her breast. The claimant also suffered travel anxiety. She required extensive treatment for her back including physiotherapy and strong medication which even two years on from the accident had not resolved matters. She was required to see a spinal surgeon on two occasions, a plastic surgeon for the scarring where it was not possible to have any treatment and therefore was deemed permanent on an attractive woman. She had to have counselling for travel anxiety.
Although the claim was settled under the small claims portal value at £25,000, general damages were significant at £20,000.
