The claimant was employed as a senior health care assistant at the Norfolk & Norwich Hospital. Their cleaning regime is carried out by contractors, Serco. One of Serco’s employees left a wet floor with no sign out and the claimant suffered a back injury when she slipped on the floor. 

Although liability was admitted for the incident by Serco’s insurers, there was a major argument between the parties as to the level of her compensation, as she had previous problems with her back and had only exacerbated these. The defendants contended that there was only a very small exacerbation. In addition, the claimant’s own expert said that she suffered from psychiatric illness requiring a report from a psychiatrist. He confirmed the diagnosis but the defendant’s own psychiatric expert felt there was no such illness.

The value of the claim was hotly disputed and the matter listed for three days argument at Norwich County Court in January 2020. At a very late stage, only three days before the trial, the claim was settled in the sum of £35,000.
