Simon Bransby acted on behalf of a chicken catcher who was injured whilst carrying out manual handling at work.
The employer admitted liability, although not in full and therefore the case was fought on liability, as well as causation/quantum.
There were large areas of dispute between the various medical experts (icluding spinal surgeons, pain experts and psychiatrists). There was a (mainly orthopaedic) dispute on whether the Claimant had suffered an injury in the index accident or alternatively would he have had similar problems in any event due to pre-existing back issues and having undertaken lot of heavy manual work over his career. The Defendants pain expert and psychiatrists were also not supportive of the Claimant’s case.
The claim settled at a round table meeting for a not insubstantial figure which included pain and suffering, loss of earnings, care/travel which the Claimant was very happy with.
